To date, the approaches to regulation have varied between nations, both with respect to the nature and specificity of the measures taken and their intended outcome. Such diversity appropriately reflects the marked differences in the existing drug use problems and public health approaches to addressing such issues between nations.
With the Lisbon Treaty now in place, the European response to drugs needs to be strong and decisive, addressing both drug demand and drug supply. New legislation involving the European Parliament, and implemented by the Member States, will be subject to the scrutiny by the European Commission and ultimately the Court of Justice of the European Union.
This paper aims to set out some of the policy and public health issues raised by the appearance of a wide range of emergent psychoactive substances of diverse origin, effect and risk profile (commonly referred to as ‘legal highs’). It will start by considering what is meant by the term ‘legal highs’ and consider the historical context that has framed their appearance and must inform any response. It will then consider some of the approaches that have been adopted by different nations to control their availability and associated harms, including a preliminary assessment of their consequences, both intended and not.

Instead of simply attempting to reduce the area planted with illicit crops, Alternative Development programmes should operate within the framework of a rural and regional development plan.

Little is known about the methamphetamine market in the region, but there are strong indications that the situation is deteriorating with substances becoming stronger, methods of use more harmful and the number of users steadily increasing. There is an urgent need for donors and governments to introduce effective harm reduction measures.
A grey area has emerged between what is legal and what is not as states struggle with how to respond to the many new synthetic compounds emerging onto the market. Of the various types of ‘Legal highs’ the seminar focused on stimulants because of the parallels with the other main drug-policy issue of the moment; i.e. the status of traditional herbal stimulants. These older discussions have been reinvigorated by: Bolivia’s efforts to de-schedule coca-leaf at UN level; the debates on the status of khat between EU States, and of kratom across Asia; and the increasing stride of legitimate cannabis use on the domestic front, as in for example Spain.
In 1976 the Netherlands adopted a formal written policy of non-enforcement for violations involving possession or sale of up to 30 g of cannabis. The ‘gateway theory’ has long been seen as an argument for being tough on cannabis, but interestingly, the Dutch saw that concept as a rationale for allowing retail outlets to sell small quantities. Rather than seeing an inexorable psychopharmacological link between marijuana and hard drugs, the Dutch hypothesized that the gateway mechanism reflected social and economic networks, so that separating the markets would keep cannabis users out of contact with hard-drug users and sellers.
Several members of California's congressional delegation are taking their concerns about a federal crackdown on the state's medical marijuana dispensaries directly to President Barack Obama. In a bipartisan letter signed by nine members of the U.S. House of Representatives, the lawmakers criticized what they called an "unconscionable" multi-state effort targeting medical marijuana dispensaries. They also called for the reclassification of marijuana as a controlled substance subject to fewer federal restrictions.
A group of medical and criminal law experts are moving forward with drafting a plan that would clear marijuana for medicinal use. "There is a consensus between parties in the coalition and with the opposition that making marijuana legal for medical purposes is a good thing," said National Anti-Drug Coordinator Jindřich Vobořil, deputy chairman of the committee drafting the proposal.
Coffee shops in the Dutch city of Maastricht have banned foreign tourists, except those from Germany and Belgium, from entering their premises. "A number of people will leave disappointed, and we are not very proud of refusing entry to visitors who have come to our shops for the last 28 years and never caused a problem," said Marc Josemans, president of the Society of United Coffeeshops and owner of the Easy Going coffee shop. "The question now will be if they instead buy from the illegal drug runners here or if they buy illegally in their own countries."
Foreign visitors will no longer be welcome to purchase cannabis in the coffee shops of Dutch border city Maastricht, unless they can prove that they are from the Netherlands, Belgium or Germany. All other clients have to return to the illegal circuit in their own country, which will create problems in those countries, according Marc Josemans, chairman of the association of Maastricht coffee shops. "It's also partly the governments' fault in these countries. Never did the Belgian, French, German or Italian, for example, governments take their responsibilities by creating a system like we did in Holland - a safe system where people can buy their cannabis products without being approached for hard drugs and without being contacted by criminals."
On August 2, 2011 the Minister of Justice presented to the Committee on Social Affairs of the Greek Parliament the changes proposed by the legislative committee to reform the drug laws. The basic reforms of the law include: the decriminalization of drug use. The proposal considers drug use as an act of self-harm and has to be addressed by the legislator in the same way as dependence of tobacco or alcohol which are not less dangerous and harmful to health but are not considered as crime.
The Netherlands is embarking on a crusade against its multi-billion-euro marijuana industry, with significant implications both for its economy and its famously liberal approach to life. A measure expected to be passed in parliament by the end of this year will have coffee shops operate as members-only clubs, meaning that only local residents will be eligible to register for "weed passes," effectively barring foreigners from buying soft drugs.
The California Medical Association, representing more than 35,000 physicians statewide, questions the medical value of pot and acknowledges some health risk from its use but urges it be regulated like alcohol. It is the first major medical association in the nation to urge legalization of the drug. Dr. Donald Lyman, who wrote the group's new policy, attributed the shift to growing frustration over California's medical marijuana law, which permits cannabis use with a doctor's recommendation. That has created an untenable situation for physicians: deciding whether to give patients a substance that is illegal under federal law.
There is a tendency within the civil society groups and academic writings that look at international drug control to focus heavily on the UN Single Convention of 1961. In many ways this is understandable and correct. It is the legal keystone for the international system and the basis for subsequent treaties. However, an over emphasis on the Single Convention may also serve to blur the deep historical forces at work within the system, as well as the actual nature of the 1961 Convention itself.
On Monday September 12 Denmark’s first mobile injection room made its maiden voyage, driving from Victoriagade to Reventlowsgade behind Central Station. The room is actually an outdated German ambulance that has room for three intravenous drug addicts, and a doctor and a nurse who can give first aid or other medical assistance. The introduction of the mobile injection rooms draws to a close 35 years of pointless drugs policies in Vesterbro.
An unprecedented 50 percent of Americans think it's high time that marijuana should become legal in the United States, according to a Gallup poll. That's up from 46 percent from a year ago -- and way up from a mere 12 percent in 1969, when Gallup first asked the question and 84 percent of respondents opposed to legalization. "If this current trend on legalizing marijuana continues, pressure may build to bring the nation's laws into compliance with the people's wishes," the pollsters said in a statement.
Peru's leftist government has scored some early victories in its bid to overhaul anti-drugs policy in the world's top coca grower while keeping the United States as a key partner, the country's new drug czar said. Ricardo Soberon, a lawyer who previously worked for a legislator with close links to coca growers, was seen as a risky choice to lead anti-drug efforts in a country that may surpass Colombia as the world's top cocaine producer.
Four California-based U.S. attorneys have announced their intent to prosecute the medical-marijuana dispensaries, growers and delivery services that are breaking state and federal laws. What constitutes violations of law, however, is murky — and may put the very existence of the dispensaries at risk. "California law says that it's essentially O.K. to grow, have and transport marijuana if you're a patient authorized by a doctor or if you're the patient's primary caregiver and if you're providing the marijuana not for profit," a spokesman for the U.S. attorney says. "Stores are violating California law because they're operating at a profit and they're not a primary caregiver. It's very clearly laid out."
