International tensions over Uruguay’s decision to regulate the cannabis market reached new levels when Raymond Yans, president of the International Narcotics Control Board (INCB), accused Uruguay of negligence with regard to public health concerns, deliberately blocking dialogue attempts and having a "pirate attitude" towards the UN conventions. President Mujica reacted angrily, declaring that someone should "tell that guy to stop lying," while Milton Romani, ambassador to the Organisation of American States (OAS), said that Yans "should consider resigning because this is not how you treat sovereign states."

Mujica batted down the criticism, insisting that his administration is open to discussing the law and accusing the INCB President Raymond Yans of applying a double standard by criticizing Uruguay, even as U.S. states pass laws to legalize recreational marijuana consumption. "Tell this old guy not to lie," Mujica said.

The Transnational Institute (TNI) organized an expert seminar on Costs and Benefits of Cannabis Regulation Models in Europe in Amsterdam, The Netherlands on October 31/November 1, 2013. The objective of the seminar was to identify and map existing and possible future cannabis regulation models in Europe, looking at the local, provincial and national levels and the potential impact of such models on the illicit cannabis market.
This week both the UN Commission on Narcotic Drugs (CND) in Vienna and the UN General Assembly 3rd Committee in New York discuss new drug control resolutions related to upcoming reviews of global drug policy. The high-level CND review in March 2014 and the Special Session of the General Assembly (UNGASS) on drugs in 2016 provide opportunities to change course and to ensure drug policy fully respects human rights.
For fifty years the World’s attitude to and treatment of the coca leaf and coca farmers has been controlled by the UN Drugs Conventions beginning with the Convention of 1961 which prohibited the production, possession and purchase of the coca leaf as well as cocaine. The assertion of this report is that the illegal status of the coca leaf is based upon a misinterpretation of science, first of all in 1950 with the publication of the misleading study of the Commission of Enquiry on the Coca Leaf; and much later with the blocking of the publication of a report in 1995 by the World Health Organisation (WHO) which made abundantly clear that the coca leaf itself has “no negative health effects”.
Reflections upon this year’s CND are mixed. On the one hand, some states went further than ever before in openly challenging the current regime on the grounds that, after a century, it needs modernising. That the government of Uruguay is currently considering a domestic policy on cannabis that would put it in breach of the Single Convention shows that, in one instance at least, we have moved beyond rhetoric and posturing.
Latin America has emerged at the vanguard of efforts to promote debate on drug policy reform. For decades, Latin American governments largely followed the drug control policies and programs of Washington’s so-called war on drugs. Yet two parallel trends have resulted in a dramatic change in course: the emergence of left-wing governments that have challenged Washington’s historic patterns of unilateralism and interventionism and growing frustration with the failure of the prohibitionist drug control model put forward by the US government.
Global drug policy must move away from stigmatizing and criminalizing users and focus on the public health issues at stake, panelists concluded at the third drug policy debate hosted by CEU’s School of Public Policy and the Open Society Foundations’ Global Drug Policy Program on April 11. Panelists expressed hope that the current momentum in this direction will result in significant changes at the United Nations drug policy summit slated for 2016.

Over the past years, there have been some soft and hard defections on cannabis control. It is now time to discuss alternatives that are based on facts and evidence, said Dave Bewley Taylor introducing the session. TNI worked on a report on cannabis, which is looking at the hard defections in the United States and other types of cannabis regulation that have been happening around the world. The report also discusses how cannabis was included in the UN drug control conventions.
The Secretary General of the OAS highlighted the assignment received during the Sixth Summit of the Americas in 2012, which urged the OAS to analyze the results of drug policies in the Americas and to explore new approaches to strengthen these efforts and make them more effective. The Foreign Minister of Guatemala emphasized that, 50 years after signing the United Nations Single Convention on Narcotic Drugs of 1961, "the world starts the task of reflection and evaluation of what we have been doing and how we can achieve more effective results."
A whiff of change is in the air regarding drug control policy. Officials in two American states, Colorado and Washington, are pondering how to implement their voters’ decisions last November to legalise cannabis. One immediate consequence is that the United States will be in breach of the UN Convention. Good. It should now join Latin American governments in an effort to reform that outdated document to allow signatories room to experiment. Imposing a failed policy on everybody benefits nobody.
Partial reforms have their limits. Most drug crime is not cannabis-related. Moving from punishment to harm reduction may help drug users, but it leaves gangsters in control of supplies and revenues. Many countries still stick to prohibition. The votes in Colorado and Washington were hardly imaginable ten years ago and make deeper change likely. They weaken the Single Convention, the illegal trade, and the prohibition industry that feeds on it.
Tradition is disposable. Evidence is marginal. Economic arguments are not important. This, in a nutshell, is what Sweden said to the UN to oppose traditional uses of coca in Bolivia. It is opposite of what it says to the EU to defend the use and sales of snus at home. Sweden may have gained a small amount of favour from the US, and it may have further promoted its reputation for being tough on drugs, but it did so by contradicting itself, providing clear ammunition to those who would seek to enforce the ban on snus and ensure that the export ban is not lifted.
Bolivia will again belong to the 1961 Single Convention on Narcotic Drugs after its bid to rejoin with a reservation that it does not accept the treaty’s requirement that “coca leaf chewing must be banned” was successful Friday. Opponents needed one-third of the 184 signatory countries to object, but fell far, far short despite objections by the US and the International Narcotics Control Board.
