Ahead of the High-Level Segment on the world drug problem to take place on 13th and 14th January 2014, the UNODC Executive Director, Yuri Fedotov, has released his "contributions" to the debate. This 19-page document is, in parts, refreshingly honest about the “unequal” progress that has been made since 2009 (with reductions in supply or demand for some drugs in some places being offset by increases elsewhere), the setbacks and new challenges, and the fact that “the overall magnitude of drug demand has not substantially changed at the global level”.

Globally, communities are blighted by drug-related crime. Citizens see huge amounts of their taxes spent on harsh policies that are not working. But despite this clear evidence of failure, there is a damaging reluctance worldwide to consider a fresh approach. International tensions over Uruguay’s decision to regulate the cannabis market reached new levels when Raymond Yans, president of the International Narcotics Control Board (INCB), accused Uruguay of negligence with regard to public health concerns, deliberately blocking dialogue attempts and having a "pirate attitude" towards the UN conventions. President Mujica reacted angrily, declaring that someone should "tell that guy to stop lying," while Milton Romani, ambassador to the Organisation of American States (OAS), said that Yans "should consider resigning because this is not how you treat sovereign states."
UN’s International Narcotics Control Board (INCB) unprecedented condemnation of the use of death penalty for drug-related offences is welcome if long overdue. The bigger question is whether INCB’s consideration of human rights can be extended into a proper human rights and evidence-based examination of UN’s entire drug control regime.
The upcoming United Nations General Assembly Special Session on Drugs (UNGASS) in 2016 is an unprecedented opportunity to review and re-direct national drug control policies and the future of the global drug control regime. As diplomats sit down to rethink international and domestic drug policy, they would do well to recall the mandate of the United Nations, not least to ensure security, human rights and development.
Country delegations to the UN Commission on Narcotic Drugs (CND) don’t usually vote on things… The protocol is that member states reach consensus on language and policy (often meaning that the final language reflects the lowest common denominator). Usually this diplomatic process works and delegates compromise. However, at the most recent inter-sessional meeting of the CND on 5th November, some delegates drew “red lines” and staked out non-negotiable positions on key issues.
In a press conference at the United Nations in New York on October 9, US official William Brownfield laid the groundwork for a new US approach to international drug policy, pointing to the changing political landscape on drug regulation in the Americas.
The UN General Assembly Special Session (UNGASS) on drugs – held in New York in April 2016 – was hailed as an opportunity for the international community ‘to conduct a wide-ranging and open debate that considers all options’. Although the UNGASS was characterised by many shortcomings and disappointments, it was nonetheless a critical moment for global drug policy reform.
Drug law reform continues developing in the right direction in several Latin American and Caribbean countries. In Jamaica, for example, a law legalizing the cultivation and consumption of ganja for medicinal, religious and research purposes came into force, as well as the decriminalisation of possession for personal use. Jamaica also spoke out at the UN Thematic Debate in New York. On May 7th, the minister addressed the UN High Level Thematic Debate on international drug policy, highlighting Jamaica’s perspectives on drug control policies and participating in a debate that encourages open and inclusive discussions. Amongst the outcomes Jamaica would like to see from UNGASS is “the establishment of an Expert Advisory Group to review the UN drug policy control architecture, its system-wide coherence, its treaty inconsistencies and its legal tension with cannabis regulations.”

An internal United Nations draft document leaked last weekend has offered outsiders a rare look at longstanding disagreements between member states over the course of U.N. drug policy. The document, first publicised by The Guardian and obtained by IPS, contains over 100 specific policy recommendations and proposals from member states, many at odds with the status quo on illicit drug eradication and prohibition.
UN forums in recent years have witnessed more and more governments expressing their frustrations with the failing global war on drugs. This failure goes way beyond just the goals of drug control systems to reduce illicit drug production and use. The key driver of calls for change has been the catastrophic negative impacts of the war on drugs on public health, human rights, development and security.

As we approach the 2016 UNGASS, this primer is a tool to better understand the role of these conventions, the scope and limits of their flexibility, the mandates they established for the CND, the INCB and the WHO, and the various options for treaty reform.
