In April 2016, representatives of the world’s nations will gather to evaluate drug policy in a United Nations General Assembly Special Session (UNGASS). While prohibitionist policies are still the norm, a rising tide of voices are demanding evidence based responses that respect human rights, promote public health, and reduce crime.
The Vienna Declaration is a statement seeking to improve community health and safety by calling for the incorporation of scientific evidence into illicit drug policies. We are inviting scientists, health practitioners and the public to endorse this document in order to bring these issues to the attention of governments and international agencies, and to illustrate that drug policy reform is a matter of urgent international significance. We also welcome organizational endorsements.
The academic journal Nueva Sociedad recently released an issue to promote the debate in Latin America on drug policy reform. TNI contributed with the paper "Drug policy reform in practice: Experiences with alternatives in Europe and the US".
As the United Nations launches the 2009 World Drug Report this week, more than 40 international groups and experts worldwide today issued a call to action that presses governments to adopt a humane approach to drug policy.
The call to action, signed by the Transnational Institute (TNI), the Global Fund to Fight AIDS, Tuberculosis and Malaria, former president of Brazil Fernando Cardoso, and others, urges governments to enact policies that are based on scientific and medical research rather than politics.
On Monday the 18th, at the UN-ECOSOC session in New York, elections took place for six members of the International Narcotics Control Board (INCB). The Board consists of only 13 members, so almost half of this UN body was up for election. Taking a look at the INCB-section on our website quickly reveals our troubled history with this ‘quasi-judicial’ and supposedly independent body that monitors compliance with the UN drug control treaties.
NGOs in the drug policy field have criticised the outcome of the recent elections to the United Nation’s International Narcotic Control Board (INCB) because the process of trading votes between member states has led to the exclusion of some of the most highly qualified candidates, and the re-election of at least one candidate who does not fit the stated criteria, Tatyana Dmitrieva.
A clear divide in drug control approaches became apparent at the end of the High Level Segment of the Commission on Narcotic Drugs (CND) on March 11-12 in Vienna, where countries gathered to review to progress since the 1998 UN General Assembly Special Session (UNGASS) and set a framework for the next 10 years through a Political Declaration and Plan of Action.
At one side of the divide a growing number of countries opt for pragmatic evidence-based harm reduction policies, while at the other side countries desperately cling to a zero tolerance approach that has failed to produce any significant result the past decade. Despite the diplomatic façade, the conclusion cannot be otherwise that the Vienna consensus on drug control that has paralysed progress in international drug control for decades, has fallen apart.

This report commissioned by the European Commission, found no evidence that the global drug problem has been reduced during the period from 1998 to 2007 – the primary target of the 1998 UNGASS, which aimed to significantly reduce the global illicit drugs problem by 2008 through international cooperation and measures in the field of drug supply and drug demand reduction. Broadly speaking the situation has improved a little in some of the richer countries, while for others it worsened, and for some of those it worsened sharply and substantially', among which are a few large developing or transitional countries. Given the limitations of the data, a fair judgment is that the problem became somewhat more severe.

The Executive Director of UNAIDS, Michel Sidibé, wrote a letter to the delegates negotiating the Political Declaration for the 52nd session of the UN Commission on Narcotic Drugs (CND) in Vienna on March 11-12, 2009, dedicated to review of the progress achieved and the difficulties encountered by in meeting the goals and targets set out in the 1998 UNGASS.
A useful overview of UN endorsement of harm reduction measures; the legality of harm reduction services under the Drug Conventions; the obligation in human rights law to ensure access to harm reduction services and the global state of harm reduction, listing 82 countries and territories worldwide that presently support or tolerate harm reduction.
The United Nations should overhaul the operations of the International Narcotics Control Board (INCB), the quasi judicial body that monitors states’ implementation of their obligations under the UN drug conventions. The Board ignores UN policies and conventions which recognize the need to provide humane treatment to people addicted to injection drugs, according to a recent commentary in medical journal The Lancet.
The Hungarian Civil Liberties Union (HCLU) made some interesting video news items on the Commission on Narcotic Drugs. In this one leading civils society spokespersons comment Mr. Costa, the UNODC Executive Director, opening speech. Costa's opening speech was somewhat surprising in that he coincided on some points that have been raised by civil society groups over the past years. He stressed that too many people in prison, and too few in health services; that there are too few resources for prevention, treatment, and rehabilitation; and that there is too much eradication of drug crops, and not enough eradication of poverty.
In a new report released in February 2008 by the International Harm Reduction Association (IHRA), the INCB comes in for some heavy criticism for being overly secretive, closed to external dialogue with civil society, and out of kilter with similar agencies in other UN programmes. IHRA also debunks the INCB’s defence that it is ‘unique in international relations’.
Conflicting views and policies within the UN system on harm reduction have become a major concern. Consistency in messages is crucial especially where it concerns joint global programmes such as the efforts to slow down the HIV/AIDS epidemic; efforts in which harm reduction practices like needle exchange and substitution treatment play a pivotal role.
The US pressure on the UNODC to withdraw support from needle exchange and other harm reduction approaches backfired at the 48th session of the CND in March 2005. Delegates from around the globe stood up to defend the overwhelming evidence that harm reduction measures are effective against the spread of HIV/AIDS. In this briefing TNIanalyses the proceedings and results of the CND meeting in Vienna in March 2005, and outlines several options for follow-up and recommends next steps to take.
