UN’s International Narcotics Control Board (INCB) unprecedented condemnation of the use of death penalty for drug-related offences is welcome if long overdue. The bigger question is whether INCB’s consideration of human rights can be extended into a proper human rights and evidence-based examination of UN’s entire drug control regime.
On 29 June 2011, the Bolivian government denounced the 1961 Single Convention on Narcotic Drugs as amended by the 1972 Protocol, indicating its intention to re-accede with a reservation allowing for the traditional use of the coca leaf. This decision was triggered by Bolivia’s need to balance its obligations under the international drug control system with its constitutional and other international legal commitments. The move follows the rejection of Bolivia’s proposal to amend the Single Convention by deleting the obligation to abolish coca leaf chewing (Article 49) earlier this year.
The backbone of the United Nations drug control system consists of three UN Drug Conventions. The prohibition of potentially harmful substances has its origin in the desire to protect human well-being. However, the way in which the global regime was set up decades ago and the escalation of repression it has brought about since, has been an historical mistake increasing rather than diminishing the problems. There is no point now in dreaming about how the world might have looked without it, or deluding ourselves that all the problems could be solved by scrapping the conventions. The challenge is to create the political space which would allow a reform process to move ahead. A process guided by pragmatism, open-mindedness and evaluation of practices on the basis of costs and benefits; providing leeway for experimentation and freedom to challenge the wisdom of the existing conventions.

Despite its unprecedented nature within the history of the international drug control regime, and regardless of warnings to the contrary, the Plurinational State of Bolivia’s withdrawal from the 1961 Single Convention on Narcotic Drugs on 1 January 2012 did not result in a collapse of the United Nations (UN) based control system. The INCB, rather than making harsh judgements based on a selective choice of outdated treaty articles, should use its mandate more constructively and help draw attention to the inherent contradictions in the current treaty system with regard to how plants, plant-based raw materials and traditional uses are treated.
Weaknesses in the United Nations drug control system have often been identified, related to the functioning of the key organs – the UN Office on Drugs and Crime (UNODC), International Narcotics Control Board (INCB), and the Commission on Narcotic Drugs (CND) –, related to collaboration with the wider UN system – the World Health Organistaion (WHO), UNAIDS, UN Development Programme (UNDP), etc. – and related to the outdated character of several treaty provisions.

A strong attack against the European practice of 'leniency' regarding cannabis use and possession took place at the United Nations Commission on Narcotic Drugs (CND) session (11-15 March, 2002) in Vienna. There was an orchestrated attempt to pass a CND resolution to put a dam against the 'leniency'.
A report published in March 2007 by the Canadian HIV/AIDS Legal Network and the Open Society Institute Public Health Program, strongly criticises the INCB. Yesterday, President Evo Morales of Bolivia sent a letter to UN Secretary General Ban Ki Moon rejecting the recommendations of the International Narcotics Control Board (INCB) to "abolish or prohibit coca leaf chewing and the manufacture of coca tea." Morales qualified the attitude of the INCB as colonial and accused the Board members of lacking the necessary scientific background.
At the Commission on Narcotic Drugs (CND) in March 2008 in Vienna three resolutions on cannabis were tabled. They were all clearly against 'lenient policies' in some countries depenalising or decriminalizing the use of cannabis. One of the resolutions called for the criminalization of drug abuse that would have significantly expanded the UN drug conventions.
When the INCB Annual Report for 2007 – under embargo until March 5 – started to circulate about a month ago, I was in complete shock after reading the worst ever paragraphs on coca written in UN history for several decades. The position taken by the Board now can be characterized by no more talk about the need to solve 'long-standing ambiguities in the conventions', not a shred of sympathy anymore for traditional customs or rights of indigenous peoples, no trace of cultural sensitivity at all, an all-out attack against coca chewing, drinking of coca tea or any other uses of coca in its natural form in the Andean region and the northern parts of Argentina and Chile.
On Monday the 18th, at the UN-ECOSOC session in New York, elections took place for six members of the International Narcotics Control Board (INCB). The Board consists of only 13 members, so almost half of this UN body was up for election. Taking a look at the INCB-section on our website quickly reveals our troubled history with this ‘quasi-judicial’ and supposedly independent body that monitors compliance with the UN drug control treaties.
International tensions over Uruguay’s decision to regulate the cannabis market reached new levels when Raymond Yans, president of the International Narcotics Control Board (INCB), accused Uruguay of negligence with regard to public health concerns, deliberately blocking dialogue attempts and having a "pirate attitude" towards the UN conventions. President Mujica reacted angrily, declaring that someone should "tell that guy to stop lying," while Milton Romani, ambassador to the Organisation of American States (OAS), said that Yans "should consider resigning because this is not how you treat sovereign states."
