A new UN study showing a steep rise in the cultivation of the leaf used to make cocaine offers fresh support to Colombia’s recent decision to end the aerial spraying of drug crops with herbicides. Justice minister, Yesid Reyes, said the report showed that the aerial aspersion strategy was ineffective. After spraying 1.5m hectares in the past 12 years, the total reduction of coca crops was just 12,000 hectares, Reyes said. Paraphrasing Albert Einstein, he added: “Insanity is to continue doing the same thing and expect different results.”
Burma/Myanmar is undergoing yet another humanitarian crisis while entering a new critical political stage. In the Kokang region, an opium ban was enforced in 2003, and since mid-2005 no more poppy growing has been allowed in the Wa region. Banning opium in these Shan State regions where most of the Burmese opiates were produced, adds another chapter to the long and dramatic history of drugs, conflict and human suffering.
A clear divide in drug control approaches became apparent at the end of the High Level Segment of the Commission on Narcotic Drugs (CND) on March 11-12 in Vienna, where countries gathered to review to progress since the 1998 UN General Assembly Special Session (UNGASS) and set a framework for the next 10 years through a Political Declaration and Plan of Action.
At one side of the divide a growing number of countries opt for pragmatic evidence-based harm reduction policies, while at the other side countries desperately cling to a zero tolerance approach that has failed to produce any significant result the past decade. Despite the diplomatic façade, the conclusion cannot be otherwise that the Vienna consensus on drug control that has paralysed progress in international drug control for decades, has fallen apart.
The Washington Office on Latin America (WOLA), the Andean Information Network (AIN), and more than 200 other concerned organizations and individuals yesterday sent a letter to U.S. Secretary of State Hillary Clinton, calling for the Obama administration to immediately withdraw its objection to Bolivia’s proposed amendment to the 1961 United Nations Single Convention on Narcotic Drugs.
The 2007 INCB Annual Report shows some signs of a more balanced approach by the INCB to the policy dilemmas around proportionality of sentences and harm reduction. While this is welcome, the Board still falls a long way short of what is necessary for it to play a positive and objective role in helping governments to find the right balance between their drug control obligations, and wider policy objectives related to social development, public health, and human rights protections. On the issue of the coca leaf especially, the INCB shows complete intransigence towards the issue of indigenous uses in the Andean region.
The United States’ State Department’s website recommends coca tea for altitude sickness, and its La Paz embassy has been known to serve it to visitors. The UN’s declaration on indigenous peoples, which the United States endorsed last month, guarantees the protection of “cultural heritage, traditional knowledge and traditional cultural expressions”.
Producers of prohibited plants face conflict from authorites and the drug market itself. Their communities are stigmatized, criminalized and incarcerated. Is coca a dangerous drug that should be tightly regulated, or an essential part of Andean indigenous people's cultural and medicinal heritage? Or perhaps both? In the coming months, diplomats at the U.N. body will face the thorny issue of how to address the production and use of coca plants in the Andes region of South America.
Bolivia’s denunciation of the 1961 Single Convention on Narcotic Drugs is not just about one treaty. It is about finding an appropriate balance between multiple concurrent and conflicting international legal obligations. When international treaties ratified by or acceded to by Bolivia and relevant jurisprudence are taken into account, it is clear that Bolivia would find itself in breach of multiple international agreements were it to fully implement the 1961 Single Convention as written. A reservation on the 1961 Single Convention is the most reasonable and proportionate way to address this conflict.
The first day at the Commission on Narcotic Drugs was marked by the announcement of President Evo Morales of Bolivia that he would start the process to remove the coca leaf from the 1961 Single Convention as well as the suspension of the paragraphs of that convention that prohibit the traditional chewing of coca leaf. Holding up a coca leaf in front of delegates at the UN summit on drugs he underlined his demand.
The UN’s International Narcotics Control Board (INCB), which monitors implementation of the global drug treaties, has trained its fire on Bolivia, this time accusing the country of threatening the integrity of the entire international drug control regime by defending traditional uses of the coca leaf.

This report commissioned by the European Commission, found no evidence that the global drug problem has been reduced during the period from 1998 to 2007 – the primary target of the 1998 UNGASS, which aimed to significantly reduce the global illicit drugs problem by 2008 through international cooperation and measures in the field of drug supply and drug demand reduction. Broadly speaking the situation has improved a little in some of the richer countries, while for others it worsened, and for some of those it worsened sharply and substantially', among which are a few large developing or transitional countries. Given the limitations of the data, a fair judgment is that the problem became somewhat more severe.
The voices of affected communities involved in the cultivation of coca leaf, opium poppy and cannabis plants are lacking in the global debate on drug policy reform in general and were at risk of being excluded from the United Nations General Assembly Special Session (UNGASS) 2016 on The World Drug Problem.

After the closure of the January 31, 2011, deadline to file objections to the Bolivian amendment to remove the ban on coca leaf chewing in the 1961 UN Single Convention on Narcotic Drugs, 18 objections were submitted. Although not required, four countries explicitly submitted their support: Spain, Ecuador, Venezuela and Costa Rica. Egypt, Macedonia and Colombia withdrew their objections.
