Today, on the United Nations’ International Day Against Drug Abuse and Illicit Trafficking (26th June), governments around the world are commemorating their decades-long support of the global war on drugs.
How can we resolve the tensions between current drug control policies and states’ human rights obligations? The international human rights framework clearly establishes that, in the event of conflicts between obligations under the UN Charter and other international agreements, human rights obligations take precedence. As legally regulated cannabis markets start to grow, now is the time to secure a legitimate place for small farmers using alternative development, human rights and fair trade principles.

> "The Board calls upon the Governments of Bolivia and Peru to initiate action without delay with a view to eliminating uses of coca leaf, including coca leaf chewing" and "each party to the Convention should establish as a criminal offence, when committed intentionally, the possession and purchase of coca leaf for personalconsumption". > "The Board again calls on the Governments of Bolivia and Peru to consider amending their national legislation so as to abolish or prohibit activities that are contrary to the 1961 Convention, such as coca leaf chewing and the manufacture of mate de coca (coca tea)".
Today, June 26, is the official UN International Day Against Drug Abuse and Illicit Trafficking. At the TNI Drugs & Democracy programme we have always found it a difficult day to deal with, full of mixed emotions. Too often the day has been desecrated by countries eager to highlight their toughest anti-drug actions. That includes each year a high number of executions in China especially saved up for June 26th. Killing drug law offenders to celebrate a UN day, in spite of the General Assembly adopting last year a resolution opposing the death penalty.
The opening in September 2012 of the first centre for drug addicts in Bogota is a welcome first step towards more humane and effective drug policies in Colombia’s capital city, but to be effective needs to be integrated into proper overall drugs strategy.
Human rights groups have urged the UK government to heed the recommendations of an influential parliamentary committee that has told the government to stop funnelling money into anti drug-trafficking programmes in countries that administer the death penalty. Over the past decade, the UK has given millions of pounds to help Pakistan, China and Iran combat drug smuggling. MPs and human rights groups are horrified by credible claims that the increased aid has met with a corresponding rise in arrests which, in turn, has led to more people ending up on death row, including several Britons.

A clear divide in drug control approaches became apparent at the end of the High Level Segment of the Commission on Narcotic Drugs (CND) on March 11-12 in Vienna, where countries gathered to review to progress since the 1998 UN General Assembly Special Session (UNGASS) and set a framework for the next 10 years through a Political Declaration and Plan of Action.
At one side of the divide a growing number of countries opt for pragmatic evidence-based harm reduction policies, while at the other side countries desperately cling to a zero tolerance approach that has failed to produce any significant result the past decade. Despite the diplomatic façade, the conclusion cannot be otherwise that the Vienna consensus on drug control that has paralysed progress in international drug control for decades, has fallen apart.
The "Beyond 2008" NGO Forum was held in Vienna, Austria from July 7-9, 2008. It was the final step in the global consultation of NGOs involved in responding to drug related problems and to provide civil society input for the 10-year UNGASS review.
Three draft resolutions and the draft declaration were subject to a line by line examination and intense debate. At the end of the Forum the Declaration and three Resolutions were adopted by consensus by all those participating in the Forum. This was an historic achievement and reflected the maturity and commitment of the global NGO community.

At the end of 2008, about 1,500 persons were released who were in Ecuadorian prisons sentenced for drug trafficking. The measure, known as “pardon for mules,” singled out a specific group of prisoners who were victims of indiscriminate and disproportionate legislation that was in effect for many years. Although with this measure, the Government of Rafael Correa took an important step in the process of reforming draconian legislation regarding controlled substances in his country, it is still to be completed with new legislation.
The issue of harm reduction continues to be controversial during the negotiations in Vienna for the Political Declaration that has to be adopted in March 2009 at the High Level Segment of the Commission on Narcotic Drugs (CND). There is severe pressure on delegates to drop their insistence on incorporating the language and principles of harm reduction in the political declaration, or to accept some watered down version.
It is unfortunate that 35 years after the first chemical spraying in the Sierra Nevada de Santa Marta, we are still writing about aerial sprayings in Colombia, demanding the current government to definitely defer an ecocide and incompetent policy.
This week both the UN Commission on Narcotic Drugs (CND) in Vienna and the UN General Assembly 3rd Committee in New York discuss new drug control resolutions related to upcoming reviews of global drug policy. The high-level CND review in March 2014 and the Special Session of the General Assembly (UNGASS) on drugs in 2016 provide opportunities to change course and to ensure drug policy fully respects human rights.
The Annual Report of the International Narcotics Control Board (INCB), released today, calls upon States that ‘continue to impose the death penalty for drug-related offences to consider abolishing the death penalty for such offences’.
The police, who used to shoot first and ask questions later in Santa Marta, a Rio de Janeiro shantytown, are now getting on well with the local community – the result of a state government plan that nevertheless has drawn criticism. Out of long habit, many local residents in the Santa Marta "favela" do not dare talk openly about the police who have been permanently posted in their neighbourhood for the past six months, as part of what the Rio de Janeiro state government describes as a plan to "pacify" the slums.

Executions for drug offences have escalated in countries such as Iran and Saudi Arabia against a trend towards abolition globally, reveals a new Harm Reduction International (HRI) report The Death Penalty for Drug Offences, Global Overview 2012: Tipping the Scales for Abolition. The report reveals that over 540 people were executed for drug offences in Iran in 2011, a trend that continues in 2012 and represents a five-fold increase since 2008. At least 16 people were executed for drugs in Saudi Arabia in the first six months of 2012, compared with one person in 2011.
