The Transnational Institute (TNI) organized an expert seminar on Costs and Benefits of Cannabis Regulation Models in Europe in Amsterdam, The Netherlands on October 31/November 1, 2013. The objective of the seminar was to identify and map existing and possible future cannabis regulation models in Europe, looking at the local, provincial and national levels and the potential impact of such models on the illicit cannabis market.
A strong attack against the European practice of 'leniency' regarding cannabis use and possession took place at the United Nations Commission on Narcotic Drugs (CND) session (11-15 March, 2002) in Vienna. There was an orchestrated attempt to pass a CND resolution to put a dam against the 'leniency'.

This report commissioned by the European Commission, found no evidence that the global drug problem has been reduced during the period from 1998 to 2007 – the primary target of the 1998 UNGASS, which aimed to significantly reduce the global illicit drugs problem by 2008 through international cooperation and measures in the field of drug supply and drug demand reduction. Broadly speaking the situation has improved a little in some of the richer countries, while for others it worsened, and for some of those it worsened sharply and substantially', among which are a few large developing or transitional countries. Given the limitations of the data, a fair judgment is that the problem became somewhat more severe.

The way the world looks at drug control is changing. There has been a growing awareness of the issue for the past decade, as well as increasing public outcry over what many see as a failure of the once popular "war on drugs." Nowhere is this battle more pronounced than in the so-called "marijuana wars," which are slowly growing into an old-fashioned standoff between the states and the federal government.
Partial reforms have their limits. Most drug crime is not cannabis-related. Moving from punishment to harm reduction may help drug users, but it leaves gangsters in control of supplies and revenues. Many countries still stick to prohibition. The votes in Colorado and Washington were hardly imaginable ten years ago and make deeper change likely. They weaken the Single Convention, the illegal trade, and the prohibition industry that feeds on it.
Over the past years, there have been some soft and hard defections on cannabis control. It is now time to discuss alternatives that are based on facts and evidence, said Dave Bewley Taylor introducing the session. TNI worked on a report on cannabis, which is looking at the hard defections in the United States and other types of cannabis regulation that have been happening around the world. The report also discusses how cannabis was included in the UN drug control conventions.
These are interesting times for drug law reform, which, as it gathers pace, is asking important questions of international law. A UN General Assembly Special Session on Drugs is set for 2016 just as national reforms are challenging international treaties that form the bedrock of a global prohibition regime that has dominated since the turn of the twentieth century. States parties to the three UN drug control conventions must now confront the legal and political dilemmas this creates. This is the situation in which the US now finds itself following cannabis reforms in various states that are at odds with these treaties.
International tensions over Uruguay’s decision to regulate the cannabis market reached new levels when Raymond Yans, president of the International Narcotics Control Board (INCB), accused Uruguay of negligence with regard to public health concerns, deliberately blocking dialogue attempts and having a "pirate attitude" towards the UN conventions. President Mujica reacted angrily, declaring that someone should "tell that guy to stop lying," while Milton Romani, ambassador to the Organisation of American States (OAS), said that Yans "should consider resigning because this is not how you treat sovereign states."
Legalisation of cannabis is making slow but unstoppable progress across much of the developed world, many experts believe, following the end of prohibition in two US states. In Amsterdam, long famous for its coffee shops, international experts gathering to discuss cannabis regulation said the international conventions, once so heavily policed by the US, would now be increasingly flouted. Already many countries, most notably the Netherlands and Spain, have bypassed the rules.
At the Commission on Narcotic Drugs (CND) in March 2008 in Vienna three resolutions on cannabis were tabled. They were all clearly against 'lenient policies' in some countries depenalising or decriminalizing the use of cannabis. One of the resolutions called for the criminalization of drug abuse that would have significantly expanded the UN drug conventions.

On thursday 28 February 2008 the Dutch Parliamentary Justice Commission devoted its debate to the drugs UNGASS review. Martin Jelsma was invited as one of the experts to share with the commission TNI's views on the importance of the review process. In his contribution he highlights the opportunity to use the 2008/9 period to achieve a breakthrough on harm reduction acceptance at the UN level, to evaluate the performance of UN agencies like UNODC and the INCB, and to open the door for a revision of the UN drug control treaty system. only available in Dutch
Minister of Industry, Investment and Commerce, Anthony Hylton, says Jamaica intends to lead a charge in the United Nations to effect changes to the international treaties concerning marijuana. The aim is to change the schedule class of marijuana in light of scientific studies that have proven its therapeutic benefits and medicinal value. "Jamaica intends to participate, and to lead, if necessary, a process in the United Nations to have those treaties amended," Hylton said.
The Uruguayan government has made a controversial move to regulate the production and sale of cannabis, believing that this will help in the fight against drug-related crime and in dealing with public health issues. The move has been condemned by the UN’s International Narcotics Control Board (INCB), whose president Raymond Yans accused the government of having a "pirate attitude" for going against the UN’s conventions on drugs. Diego Cánepa, secretary of the office of Uruguayan President, believes a regulated marijuana market was the right decision.
The head of the UN Office on Drugs and Crime (UNODC), Antonio Costa, recently visited Amsterdam on 24 April. Accompanied by some officials of the Netherlands Ministry of Health and of the City of Amsterdam and UNODC staff, he dropped in on the coffeeshop De Dampkring (the Atmosphere) and a user room (for inhalation and injection of heroin and cocaine). He wrote his personal account for his blog Costa’s corner but it was never published. Apparently it proved to be too controversial with his Dutch host. It now has popped up on the Transform drug policy blog and the ENCOD website.
Latin America has emerged at the vanguard of efforts to promote debate on drug policy reform. For decades, Latin American governments largely followed the drug control policies and programs of Washington’s so-called war on drugs. Yet two parallel trends have resulted in a dramatic change in course: the emergence of left-wing governments that have challenged Washington’s historic patterns of unilateralism and interventionism and growing frustration with the failure of the prohibitionist drug control model put forward by the US government.
Uruguay's President Mujica shot back at the president of the International Narcotics Control Board, a U.N. agency, for saying that his administration refused to meet with the agency’s officials before legalizing marijuana. Mujica batted down the criticism, insisting that his administration is open to discussing the law and accusing the INCB President Raymond Yans of applying a double standard by criticizing Uruguay, even as U.S. states pass laws to legalize recreational marijuana consumption. "Tell this old guy not to lie," Mujica said.
