Reflections upon this year’s CND are mixed. On the one hand, some states went further than ever before in openly challenging the current regime on the grounds that, after a century, it needs modernising. That the government of Uruguay is currently considering a domestic policy on cannabis that would put it in breach of the Single Convention shows that, in one instance at least, we have moved beyond rhetoric and posturing.
Policy changes over the past five years or so have dramatically reshaped the global cannabis market. Not only has there been an unprecedented boom in medical markets, but following policy shifts in several jurisdictions a growing number of countries are also preparing for legal regulation of non-medical use. Such moves look set to bring a clear range of benefits in terms of health and human rights. As this groundbreaking Report, highlights, however, there are also serious concerns about the unfolding market dynamics.
The Netherlands is embarking on a crusade against its multi-billion-euro marijuana industry, with significant implications both for its economy and its famously liberal approach to life. A measure expected to be passed in parliament by the end of this year will have coffee shops operate as members-only clubs, meaning that only local residents will be eligible to register for "weed passes," effectively barring foreigners from buying soft drugs.
Two prominent El Paso political leaders argue, in their new book, that the United States' war on drugs is not working despite a $1 trillion infusion of federal money over the past 40 years. Former city Rep. Beto O'Rourke and city Rep. Susie Byrd co-authored the recently published book, "Dealing Death and Drugs." The book is billed as "an argument to end the prohibition of marijuana." The authors contend the only rational alternative to the multi-billion dollar war on drugs is to end the present prohibition on marijuana.
As the UN International Narcotics Control Board (INCB) launches its annual report on Tuesday, 4 March, amidst an unprecedented crisis in the international drug control regime, leading drug policy reform experts have called on the INCB and related UN institutions to urgently open up a constructive dialogue on international drug policy reform.
If D.C. residents vote to legalize marijuana possession next week, it wouldn’t just mean a sea change in drug policy in the nation’s capital. It could also mean big business. A study by District financial officials shared with lawmakers estimates a legal D.C. cannabis market worth $130 million a year. The ballot initiative voters will see Tuesday does not allow for the legal sale of marijuana — only the possession and home cultivation of small amounts — but D.C. Council members gathered Thursday to hear testimony about what a legal sales regime might look like.

The IV Symposium on Medicinal Cannabis in Brazil focused on patients who need treatment via medicinal cannabis and its components. Today, these patients struggle with access to such treatment, mainly due to bureaucracy. The event undoubtedly generated attitudes in favor of medical marijuana in the country. However, and unfortunately, less than 10 days after the event ended, National Health Surveillance Agency (ANVISA) postponed a vote for the reclassification of cannabis.
While Copenhagen's mayor, Frank Jensen, continues to be a vocal advocate for legalising cannabis in the city, arguing that a "paradigm shift" is in order, Copenhagen Police took a strikingly different approach Thursday. As part of the newly-announced 'Task Force Pusher Street', police arrested 28 individuals at Christiania. Jensen argued that the city "needs to go a new way". In an interview with Politiken newspaper on Sunday, the mayor said that the traditional police approach hasn’t worked before and is unlikely to work now.
International tensions over Uruguay’s decision to regulate the cannabis market reached new levels when Raymond Yans, president of the International Narcotics Control Board (INCB), accused Uruguay of negligence with regard to public health concerns, deliberately blocking dialogue attempts and having a "pirate attitude" towards the UN conventions. President Mujica reacted angrily, declaring that someone should "tell that guy to stop lying," while Milton Romani, ambassador to the Organisation of American States (OAS), said that Yans "should consider resigning because this is not how you treat sovereign states."
The city of Copenhagen should be growing its own weed, said its mayor. According to Social Democrat Frank Jensen, the Danish capital can only get a grip on its huge trade in Cannabis if the state itself muscles in and displaces the pushers. Aware that a municipal government peddling its own grass might sound a little crunchy, Jensen is emphasizing the proposal's seriousness. "This isn’t a hippie proposal," he told newspaper Berlingske. Politicians in Denmark have closed their eyes and the cannabis market has gone completely out of control. The criminalization of cannabis has not led to lower consumption. On the contrary. The naive ban caused only more crime and greater use, especially among young people. The cannabis market in Denmark should be legalized, says an editorial in the centre-left Danish newspaper Politiken. Copenhagen mayor Frank Jensen rejects the Swedish concern about regulation of cannabis in Copenhagen. He emphasizes that the aim of the experiment is to remove the criminal gangs monopoly on the sale of marijuana. "We will eliminate a billion dollar business from organized crime. All figures show that the consumption of cannabis in Denmark has just risen and risen over the past several years, despite the fact that we have a ban in the area. A majority of Danes believe that sales of cannabis should be controlled by the state, according to a Gallup poll for metroXpress. According to the poll, 53 per cent of those asked fully agreed or agreed that cannabis should be state-controlled; 22 per cent had no view on the issue while 23 per cent disagreed or fully disagreed. Social Democratic Justice Minister Morten Bødskov recently rejected the idea of a trial arrangement in Copenhagen.

Legal tensions are growing within the international drug control regime as increasing numbers of member states move towards or seriously consider legal regulation of the cannabis market for non-medical purposes. Amongst reform options not requiring consensus, inter se modification appears to be the most ‘elegant’ approach and one that provides a useful safety valve for collective action to adjust a treaty regime arguably frozen in time.
As jurisdictions enact reforms creating legal access to cannabis for purposes other than exclusively “medical and scientific,” tensions surrounding the existing UN drug treaties and evolving law and practice in Member States continue to grow. How might governments and the UN system address these growing tensions in ways that acknowledge the policy shifts underway and help to modernize the drug treaty regime itself, and thereby reinforce the UN pillars of human rights, development, peace and security, and the rule of law?

This report commissioned by the European Commission, found no evidence that the global drug problem has been reduced during the period from 1998 to 2007 – the primary target of the 1998 UNGASS, which aimed to significantly reduce the global illicit drugs problem by 2008 through international cooperation and measures in the field of drug supply and drug demand reduction. Broadly speaking the situation has improved a little in some of the richer countries, while for others it worsened, and for some of those it worsened sharply and substantially', among which are a few large developing or transitional countries. Given the limitations of the data, a fair judgment is that the problem became somewhat more severe.
Ann Fordham of the International Drug Policy Consortium (IDPC) delivered the NGO Statement to CND Plenary under Item 8: Preparations for the high-level review of the implementation by Member States of the Political Declaration and Plan of Action on International Cooperation towards an integrated and balanced strategy to counter the world drug problem.
Where legal ambiguities and disagreement persist around cannabis policies, the INCB continues to make narrow legal interpretations of what is allowed under the UN drug conventions and repeatedly expresses its strong objection to any move towards decriminalization of possession for personal use, lowering law enforcement priorities for cannabis or reclassification.
