The United States’ demand for illicit drugs creates markets for Mexican drug trafficking organizations (DTOs) and helps foster violence in Mexico. Some government and media sources have reported that Mexican and Colombian DTOs combined earn $18–$39 billion annually in wholesale drug proceeds and 60 percent of all Mexican DTO drug export revenue comes from marijuana. These numbers have been cited to argue that legalizing marijuana in California would reduce Mexican DTOs’ revenues, thereby reducing violence.
Mexico is currently undergoing one of the worst crises in its history in terms of violence and insecurity. This crisis is directly related to the strengthening of organized crime in Mexico associated with drug trafficking, the divisions within the leading drug trafficking cartels, and their diversification. All this has resulted in a bloody struggle to control the key markets for the trafficking routes. The response of the Calderón administration has been a “war on organized crime” with two key elements: the growing use of the armed forces in public security tasks, and legal reforms aimed at more effectively fighting organized crime and, in particular, those involved in the trafficking, commerce, and supply of drugs.
Mexico’s security crisis’ most evident toll is the unacceptable level of violence linked to drug trafficking. However, a report published today by the Transnational Institute (TNI) and the Washington Office on Latin America (WOLA) reveals that there are other damaging consequences, such as increased number of prisoners and the fact that the majority of the prisoners are small-scale offenders or users, and are from the most vulnerable sectors of society.
Mexico has experienced an unprecedented rise in crime and violence over the past five years with over 47,000 people killed in crime related violence during this period. For some, the increase in violence is a tragic by-product of President Calderón’s full frontal assault on criminal organizations. For others, the government’s actions, while well intended, have only marginally impacted trafficking while exacerbating the violence.

The principal motivation for implementing this survey was the lack of existing information regarding the relationship between drug users and their social networks. There is a lack of quality indicators that provide detailed information regarding the consumption of drugs, particularly when faced with the traditional dichotomy of user-addict. This dichotomy fails to see the complexity of the consumption of illegal drugs and reiterates the notion that the drug using population will inevitably move into addiction, thus ignoring the diversity of existing patterns of consumption.
This 176-page report documents nearly 250 “disappearances” during the administration of former President Felipe Calderón, from December 2006 to December 2012. In 149 of those cases, Human Rights Watch found compelling evidence of enforced disappearances, involving the participation of state agents.
Latin America is now at the vanguard of international efforts to promote drug policy reform: Bolivia has rewritten its constitution to recognize the right to use the coca leaf for traditional and legal purposes, Uruguay has become the first nation in the world to adopt a legal, regulated Cannabis market, and Colombia, Mexico, Guatemala, and Ecuador are openly critiquing the prevailing international drug control paradigm at the UN. And now with the United States itself relaxing its marijuana laws state by state, the U.S. prohibitionist drug war strategies are losing credibility in the region.

The Research Consortium on Drugs and the Law (Colectivo de Estudios Drogas y Derecho, CEDD) has published a new study that assesses state responses to illicitly-used drugs in eight countries in Latin America: Argentina, Brazil, Bolivia, Colombia, Ecuador, Mexico, Peru and Uruguay. The study found that Latin American governments’ approach to drug use continues to be predominantly through the criminal justice system, not health institutions. Even in countries where consumption is not a crime, persistent criminalization of drug users is common.
As the world prepares for the 2016 Special Session of the United Nations General Assembly on the World Drug Problem (UNGASS 2016), an increasing number of countries around the world now find the regime’s emphasis on punitive approaches to illicit drugs to be problematic and are asking for reform. In this moment of global disagreement, the Brookings project on Improving Global Drug Policy provides a unique comparative evaluation of the effectiveness and costs of international counternarcotics policies and best approaches to reform.
The Commission on Narcotic Drugs (CND) in Vienna in March 2010 was a rather uneventful event. One of the most controversial issues were the comments of the International Narcotics Control Board (INCB) in its 2009 Annual Report on the trend to decriminalize possession for personal use in Argentina, Brazil and Mexico. Both Argentina and Mexico voiced strong objections on the INCB remarks.
Mexico's president, Felipe Calderón, has joined calls for a debate on the legalisation of drugs as new figures show thousands of Mexicans every year being slaughtered in cartel wars. "It is a fundamental debate," the president said, belying his traditional reluctance to accept any questioning of the military-focused offensive against the country's drug cartels. "You have to analyse carefully the pros and cons and key arguments on both sides." The president said he personally opposes the idea of legalisation.

Forty years after President Nixon launched the 'war on drugs' there is a growing momentum to abandon the fight.
Former President Vicente Fox is joining with those urging his successor to legalize drugs in Mexico, saying that could break the economic power of the country's brutal drug cartels. Fox's comments, posted Sunday on his blog, came less than a week after President Felipe Calderon agreed to open the door to discussions about the legalization of drugs, even though he stressed that he remained opposed to the idea.
Since marijuana provides the Mexican gangs with up to half their income, taking that business out of their hands would change the balance of power in the drug war. Californians will vote in November on whether to legalise and tax the sale of marijuana to adults. Were the proposal to pass it would render Mexico’s assault on drug traffickers untenable, reckons Jorge Castañeda, a former foreign minister. “How would you continue with a war on drugs in Tijuana, when across the border grocery stores were selling marijuana?” he asks.
Legalization of drugs -- long an issue championed mainly by fringe groups -- is rapidly moving to the mainstream in Latin America. Last week's surprise statement by former Mexican President Vicente Fox in support of "legalizing production, sales and distribution" of drugs made big headlines around the world.
"I don't think that marijuana legalization will be a panacea on drug violence in Mexico," said David Shirk, director of the Trans-Border Institute at the University of San Diego. "But legalization could change the nature of the fight. Drugs are so much more profitable than any other form of illicit activity. You take away that profitability, and you cripple the organizations' ability to corrupt the state."
Mexico's president, Felipe Calderón, launched his presidency three and a half years ago with an unprecedented military-led offensive against the country's drug cartels. Since then 28,000 people have been killed in drug-related violence that continues to escalate, with little sign that the power of the traffickers has been reduced.
Vicente Fox, the former president of Mexico, began his administration in 2000 with a popular festival. Felipe Calderón, who took over in 2006, began his with a show of military force. His affinity for uniforms, army brass bands and public events with the armed forces makes an overt connection between the military and the executive that was unusual in Mexican politics before his presidency.
A debate about legalizing marijuana and possibly other drugs — once a taboo suggestion — is percolating in Mexico, a nation exhausted by runaway violence and a deadly drug war. The debate is only likely to grow more animated if Californians approve an initiative on Nov. 2 to legalize marijuana for recreational use in their state.
