The historic measure to regulate and tax marijuana in Washington State deserves to be looked at closely as a model of how legalization ought to be designed and implemented elsewhere in America. We've turned a significant corner with the approval of Initiative 502, which purposefully offers a true public health alternative to the criminal prohibition of pot. Washington’s new pot consultant has one overarching, discouraging message for lawmakers and state budget writers: don’t look at weed as an ATM. Potential tax revenues will probably be less than half of the $450 million that’s been projected, said Mark Kleiman, in a interview Thursday night with TVW’s Austin Jenkins. More important, Kleiman said, to rely on money from pot — like money from gambling, alcohol and tobacco — means relying on abuse and addiction, which are not necessarily desirable state goals.
The President of the International Narcotics Control Board (INCB), Raymond Yans, has voiced grave concern about the outcome of recent referenda in the United States of America that would allow the non-medical use of cannabis by adults in the states of Colorado and Washington, and in some cities in the states of Michigan and Vermont. Mr. Yans stated that “these developments are in violation of the international drug control treaties, and pose a great threat to public health and the well-being of society far beyond those states”.
Voters in Colorado and Washington state who approved the recreational use of marijuana Tuesday sent a salvo from the ballot box that will ricochet around Latin America, a region that's faced decades of bloodshed from the U.S.-led war on drugs. Experts said the moves were likely to give momentum to countries such as Uruguay that are marching toward legalization, to undercut Mexican criminal gangs and to embolden those who demand greater debate about how to combat illegal substances.
Washington enthusiastically leapt into history Tuesday, becoming the first state, with Colorado, to reject federal drug-control policy and legalize recreational marijuana use. Initiative 502 was winning 55 to 45 percent, with support from more than half of Washington's counties, rural and urban. The vote puts Washington and Colorado to the left of the Netherlands on marijuana law, and makes them the nexus of a new social experiment with uncertain consequences.
Driven by a groundswell of public opinion, Colorado and Washington State last November became the first states in the U.S. to legalize the recreational use of marijuana. Advocates for the legalization of marijuana plan to step up their political giving and lobbying efforts now that members of Congress are taking an interest in changing federal drug laws. The lobbyists say lawmakers who wouldn’t give them the time of day are suddenly interested in meeting with them and introducing legislation following the approval of ballot initiatives in Colorado and Washington that legalized recreational use of the drug.
Many Washington residents are looking to cash in on the newly legal and potentially lucrative marijuana market, which they hope will give them a new start, create jobs, and boost Washington's slumping economy. Washington Liquor Control Board officials released draft rules for a legal seed-to-store marijuana system. Washington residents and out-of-staters could buy an ounce of tested, labeled marijuana, seven days a week, up to 20 hours a day, in state-regulated stores. That rule is more permissive than in Colorado, the other state creating an adult recreational-pot market. The draft rules are likely to be refined in weeks to come.
President Obama’s statement of tolerance toward legalized marijuana is welcome. The real question is not whether federal agents will go after users. In Colorado and Washington, the question is whether they will go after growers, processors and retailers that have been licensed under state law. It is whether the federal government will allow states to sanction businesses that keep accounts, pay taxes and follow state law.

Seattle's first-ever Medical Cannabis Cup — part gourmet weed contest, part trade show, part smoke-in — showcased the entrepreneurial drive and explosive growth of the local medical-marijuana industry. From dispensaries offering dozens of marijuana varieties to new potency-testing labs to makers of cannabis-infused capsules and candy corn, storefronts displaying the trademark green cross dot nearly every Seattle neighborhood. The city estimates there are at least 150 marijuana-related businesses here, more ubiquitous than Starbucks.
A handful of legislators recently drew up a letter raising questions and concerns about the law, including whether it can be implemented by December as required under voter-approved Initiative 502. Colorado's Amendment 64 Implementation Task Force is wading through the weeds of marijuana legalization, creating regulations to take pot from the shadows out into the open. In the wake of the decision by voters in Colorado last November to legalize recreational marijuana for adults, the question of how to integrate legal pot into the practical bureaucratic realities has fallen on two dozen Coloradans. By the end of the month, the Task Force must submit a report to the Colorado Legislature that lays out its suggestions for how the state should regulate legal marijuana.
The cannabis industry is an easy target for legislatures to saddle with heavy taxes. In Washington State for instance, there is a 25% tax at three different stages of cannabis production: from the grower to the processor, from the processor to the retailer, and the retailer to the customer. These taxes are in addition to any other state or local sales taxes that might apply. Oregon Representative Earl Blumenauer, for instance, has introduced marijuana reform legislation that would enact a 50% excise tax on production.
Washington state’s chief pot consultant remains a bit mysterious, but Mark Kleiman's views on legalizing pot are no mystery. He lays them out in “Marijuana Legalization,” a 2012 book he wrote with three of his team members. Alison Holcomb, the law’s author, said Kleiman’s credentials could ease federal concerns about Washington’s system evolving into an industry that tries to create addictions and market to young people. “I’m glad Kleiman and his colleagues are heading up the consulting group,” she said. A citizens' group opposed to a large-scale recreational marijuana industry in Colorado has hired two powerhouse lobbyists in preparation for the state legislature's coming pot fight. Smart Colorado formed as a nonprofit group within the last weeks, group leader Doug Robinson said. They have hired former congressional candidate Mike Feeley and longtime Capitol lobbyist Sandra Hagen Solin to represent it as legislators write the laws for the forthcoming recreational marijuana industry.
