The United States must not turn a blind eye to the recreational use of cannabis in states that liberalize drug laws, the International Narcotics Control Board (INCB) said, urging the country to live up to its treaty commitments. Raymond Yans, president of the INCB, said assurances from the U.S. government in December that growing, selling or possessing the drug remained illegal under federal law were "good, but insufficient".
The growing societal acceptance of cannabis in the U.S. has sparked what some call a "green rush" of people trying to cash in on what is already a multi-billion-dollar business. And as the marijuana industry comes out of the shadows, its producers, consumers and advocates are pushing for more transparency – both about cannabis' alleged medical benefits and its environmental impacts.
They're not talking about the landmark health care ruling. They're talking about last week's Arizona immigration ruling, in which the court reiterated a foundation of American law - that states can't buck the federal government. "Arizona may have understandable frustrations" with federal inaction on immigration, the justices wrote, "but the state may not pursue policies that undermine federal law."
Colorado officials and marijuana advocates on Wednesday looked toward an imminent confrontation with the federal government one day after voters in the state endorsed a measure to legalize marijuana for recreational use. Gov. John Hickenlooper said he is trying to speak soon with U.S. Attorney General Eric Holder to learn how the Justice Department will respond to the legalization measure's passage. Senior White House and Justice Department officials are considering plans for legal action against Colorado and Washington that could undermine voter-approved initiatives to legalize the recreational use of marijuana in those states, according to several people familiar with the deliberations.
The Washington Post’s View: we favor decriminalizing possession of small amounts of pot, assessing civil fines instead of locking people up. Also, for that reason and others, the Justice Department should hold its fire on a lawsuit challenging Colorado and Washington’s decision to behave more leniently.
While it seems unlikely that the federal government will make much of an effort to arrest pot users in Colorado or Washington—Obama has said he has “bigger fish to fry”— the tension between federal and state laws on marijuana remains. The 43-year-old war on drugs had never seen such a barrage of opposition as it did in 2014, with successful marijuana legalization initiatives in several U.S. states, California’s historic approval of sentencing reform for low level drug offenders and world leaders calling for the legal regulation of all drugs — all of which cement the mainstream appeal of drug policy alternatives and offer unprecedented momentum going into 2015.
The cry of "states' rights" is not often associated with progressive causes, but with the "war on drugs" comprehensively declared a $1tn failure by the Global Commission on Drug Policy, the call has reason and justice on its side. Will the feds carry their fight against the voices expressing popular will from California to Colorado, Washington State and beyond? Or will the White House temper its approach with respect for local democracy?
Some 20 years ago, a Spanish official in favor of lifting the ban on drugs such as marijuana mentioned at a UN meeting that there "might be a more humane option" in the fight against trafficking. She was immediately taken aside by a senior diplomat, who told her in no uncertain terms: "Don't say things like that round here, not even in the washroom." Today, the same official says that internal documents are now circulating within the UN that openly admit to the failure of prohibition.

The legalization of recreational marijuana in the U.S. states of Washington and Colorado will force Mexico to rethink its efforts to halt marijuana smuggling across the border, the main adviser to Mexico's president-elect said. Luis Videgaray, head of incoming President Enrique Pena Nieto's transition team, told Radio Formula that the Mexican administration taking power in three weeks remains opposed to drug legalization.
The technology was supposed to efficiently track medical marijuana from seed to sale — the catch-phrase that came to define Colorado's efforts to regulate what had been an outlaw business. Field investigators could walk into any dispensary or grow operation and with a digital reader instantly collect data from tags attached to everything from newly potted plants to pot-infused lollipops in a regulatory system often held up as a national model and serving as the foundation for how the state will regulate recreational pot legalized by Amendment 64. Uruguay's drug czar says every legal marijuana plant in Uruguay will be registered and tracked using radio frequency tags, and that state-grown marijuana will be cloned to include genetic markers, making sure that what's grown here, stays here. That's a much tougher tracking system than those imposed in Colorado and Washington. Uruguay wants authorities to be able to test the pot in any drug user's possession to determine if it came from a registered, legal source.
The legalisation of small amounts of marijuana for recreational use, which will allow the drug to be taxed and regulated, in two U.S. states will prompt debate on anti-drug policies in Mexico as well, and on the coordination of strategies between the two countries, experts say. “The least bad option is legalisation,” Jorge Chabat, at the Centre for Research and Teaching in Economics (CIDE), told IPS. “It will have an impact on the way prohibition is designed, because there will be a cascade effect, and we’ll see changes very soon.”
