The review of the objectives and action plans agreed at the 1998 UNGASS on Drugs has reached a critical stage. Following the thematic debate at the 2008 Commission on Narcotic Drugs, and the five expert working groups held in Vienna over the summer, the attention now moves to the political process of negotiating the text of a political declaration to be agreed at the high level meeting in March 2009.
An October statement on drug control from the US State Department has prompted much comment and speculation at home and abroad. Delivered by Ambassador William Brownfield, the ‘Brownfield Doctrine’, as it has been named by some commentators, lays out a four pillar approach the United States will follow in matters of international drug control.
Voters in Colorado and Washington state who approved the recreational use of marijuana Tuesday sent a salvo from the ballot box that will ricochet around Latin America, a region that's faced decades of bloodshed from the U.S.-led war on drugs. Experts said the moves were likely to give momentum to countries such as Uruguay that are marching toward legalization, to undercut Mexican criminal gangs and to embolden those who demand greater debate about how to combat illegal substances.
Two U.S. states have legalized recreational marijuana, and more may follow; the Obama administration has conditionally accepted these experiments. Such actions are in obvious tension with three international treaties that together commit the United States to punish and even criminalize activity related to recreational marijuana. The administration asserts that its policy complies with the treaties because they leave room for flexibility and prosecutorial discretion.
The head of the UN Office on Drugs and Crime (UNODC), Antonio Costa, recently visited Amsterdam on 24 April. Accompanied by some officials of the Netherlands Ministry of Health and of the City of Amsterdam and UNODC staff, he dropped in on the coffeeshop De Dampkring (the Atmosphere) and a user room (for inhalation and injection of heroin and cocaine). He wrote his personal account for his blog Costa’s corner but it was never published. Apparently it proved to be too controversial with his Dutch host. It now has popped up on the Transform drug policy blog and the ENCOD website.
Martin Jelsma, from the Transnational Institute, prepared an analysis for theLatin American Commission on Drugs and Democracy, explaining the drug policy situation in the European Union and the current state of debate in the United Nations agenda. The commission is an initiative born of former presidents Fernando Henrique Cardoso, from Brazil, César Gaviria, from Colombia and Ernesto Zedillo, from Mexico, to respond to concerns related to the problems of drug consumption and traffic in Latin America. The idea to constitute a commission capable of consolidating a debate concerning this problematic also responds to the necessity of reviewing the world drug policies in the scope of the United Nations, which began in March 2008.
The current trend towards legal regulation of the cannabis market has become irreversible and requires an urgent dialogue by UN member states on the best models for protecting people’s health and safety, argues a new report. The question facing the international community today is no longer whether there is a need to revise the UN drug control system, but rather when and how to do it.
The United Nations drug control conventions of 1960 and 1971 and later additions have inadvertently resulted in perhaps the greatest restrictions of medical and life sciences research. These conventions now need to be revised to allow neuroscience to progress unimpeded and to assist in the innovation of treatments for brain disorders. In the meantime, local changes, such as the United Kingdom moving cannabis from Schedule 1 to Schedule 2, should be implemented to allow medical research to develop appropriately.
Sweden joined the United States and the United Kingdom in objecting to the re-accession of Bolivia to the 1961 UN Single Convention on Narcotic Drugs after Bolivia had denounced the convention and asked for re-accession with a reservation that allows for the traditional age-old ancestral habit of coca chewing in the country. Italy and Canada also objected, but the objection of Sweden is particularly disturbing.
The Transnational Institute (TNI) organized an expert seminar on Costs and Benefits of Cannabis Regulation Models in Europe in Amsterdam, The Netherlands on October 31/November 1, 2013. The objective of the seminar was to identify and map existing and possible future cannabis regulation models in Europe, looking at the local, provincial and national levels and the potential impact of such models on the illicit cannabis market.
On 29 June 2011, the Bolivian government denounced the 1961 Single Convention on Narcotic Drugs as amended by the 1972 Protocol, indicating its intention to re-accede with a reservation allowing for the traditional use of the coca leaf. This decision was triggered by Bolivia’s need to balance its obligations under the international drug control system with its constitutional and other international legal commitments. The move follows the rejection of Bolivia’s proposal to amend the Single Convention by deleting the obligation to abolish coca leaf chewing (Article 49) earlier this year.
On April 23, 2008, the European Parliament approved a report by MEP Giusto Cataniaon the Green Paper on the role of civil society in drugs policy in the European Union. The EP, among other things, called "on the Commission and the Member States to explore ways of cooperating with EU civil-society organisations involved in promoting substances derived from coca leaves for lawful use purely as a means of contributing effectively (by absorbing raw materials) to international action against drugs trafficking, ensuring at the same time the safe use of such substances."
Bolivia will again belong to the 1961 Single Convention on Narcotic Drugs after its bid to rejoin with a reservation that it does not accept the treaty’s requirement that “coca leaf chewing must be banned” was successful Friday. Opponents needed one-third of the 184 signatory countries to object, but fell far, far short despite objections by the US and the International Narcotics Control Board.
Suppose the United States government helps to negotiate, and subsequently champions, certain framework treaties – ones justly viewed as imposing significant constraints on all signatories. Down the road, the United States occasionally even calls out counterparties for their looser policy innovations, when the latter push the outer boundaries of what’s permitted under the treaties; a treaty-created monitoring body does likewise in its annual reporting. This pattern essentially holds year in and year out and from one presidential administration to the next.
Latin America has emerged at the vanguard of efforts to promote debate on drug policy reform. For decades, Latin American governments largely followed the drug control policies and programs of Washington’s so-called war on drugs. Yet two parallel trends have resulted in a dramatic change in course: the emergence of left-wing governments that have challenged Washington’s historic patterns of unilateralism and interventionism and growing frustration with the failure of the prohibitionist drug control model put forward by the US government.
International tensions over Uruguay’s decision to regulate the cannabis market reached new levels when Raymond Yans, president of the International Narcotics Control Board (INCB), accused Uruguay of negligence with regard to public health concerns, deliberately blocking dialogue attempts and having a "pirate attitude" towards the UN conventions. President Mujica reacted angrily, declaring that someone should "tell that guy to stop lying," while Milton Romani, ambassador to the Organisation of American States (OAS), said that Yans "should consider resigning because this is not how you treat sovereign states."
State-level cannabis reforms, which gathered steam this month, have exposed the inability of the United States to abide by the terms of the legal bedrock of the global drug control system; the 1961 Single Convention on Narcotic Drugs. This is something that should force a much-needed conversation about reform to long- standing international agreements. But while ostensibly 'welcoming' the international drug policy reform debate, it is a conversation the US federal government actually wishes to avoid.
UN’s International Narcotics Control Board (INCB) unprecedented condemnation of the use of death penalty for drug-related offences is welcome if long overdue. The bigger question is whether INCB’s consideration of human rights can be extended into a proper human rights and evidence-based examination of UN’s entire drug control regime.
