    Response from IDPC to the Sentencing Council for England and Wales Consultation on the Drug Offences Guideline

    idpc-sentencing The Sentencing Council for England and Wales initiated a consultation process in order to produce definitive sentencing guidelines for drugs offences for the UK in the future. In order to feed into this process, IDPC, in collaboration with TNI, held an Expert seminar on proportionality in sentencing for drug offences, on 20th May 2011, in London, UK. The seminar was an important gathering of international experts on the subject of proportionality and provided a space for fruitful and in depth discussions on sentencing experiences from around the world. A draft report of the meeting was sent to the Sentencing Council as part of the consultation process on 20th June.

There has been official analysis of the issue by the International Narcotics Control Board (‘INCB’) and several national initiatives that have emphasised a requirement for proportionality when sentencing in statute or penal code, asserted it through the courts, or, as with the UK Consultation on sentencing for drug offences, are continuing to explore the concept through policy processes.

    En España cada vez es mas común la existencia de asociaciones que dicen producir marihuana de forma colectiva para distribuirla exclusivamente entre sus socios. Barcelona, Madrid y Bilbao son algunas de las ciudades donde durante la última década han proliferado este tipo de clubes, lo que aparentemente se debe a una ambigüedad legal que mantiene a autoridades y consumidores de cannabis en un tira y afloja constante. Las primeras agrupaciones de este tipo surgieron hacia 2001 y, a pesar de puntuales intervenciones policiales, su número se ha incrementado hasta el punto de que actualmente se desconoce cuántas funcionan en España.

    Seminario de expertos en el tema de proporcionalidad de las sentencias

    El Transnational Institute (TNI) y el Consorcio Internacional para Políticas de Drogas (IDPC) en colaboración con el Sentencing Council para Inglaterra y Gales organizaron el pasado 20 de mayo un seminario de expertos en el tema de la proporcionalidad de las sentencias para las personas acusadas por delitos relacionados con drogas. El seminario tuvo lugar en la Parliament Chamber de la ciudad de Londres.
