In this edition, the 5th Latin American and 1st Central American Conference on Drug Policy aims to be a platform for discussion and elaboration of solution-oriented proposals. The production and use of drugs is a complex phenomenon, with multiple manifestations according to the historical moment, cultural environment, economic model, the particular circumstances of a country, the different significances assigned by subjects, as well as the actual differences between substances. Nevertheless, it is reduced and homogenized as the “drug problem”, as if it was a uniform, unhistorical phenomenon.
At the upcoming Summit of the Americas, President Dilma has an unprecedented opportunity to contribute to building a new architecture for global drug policy. She can make a decisive break with the past. A new approach would emphasize public health, social justice and cultures of peace rather than repression, enforcement and war. If Brazil is to consolidate its international legitimacy and position as promoter of human rights, it needs to adopt more humane policies back home.
Despite efforts by governments in Latin America, illicit drugs continue to provide one of the largest incomes for criminal organizations, enabling them to penetrate and corrupt political and social institutions.
Guatemala will not fail to honour any of its international commitments to fighting drug trafficking. But nor are we willing to continue as dumb witnesses to a global self-deceit. We cannot eradicate global drug markets, but we can certainly regulate them as we have done with alcohol and tobacco markets. Drugs should be treated as public health problems, not criminal justice issues. Our children and grandchildren demand from us a more effective drug policy, not a more ideological response. Next weekend, leaders from the Americas will meet in Cartagena. This is an opportunity to start a realistic and responsible intergovernmental dialogue on drug policy.
In an op-ed first published in Mexico’s El Universal and Brazil’s O Globo on Tuesday, Cardoso praised the proposal’s potential to take away profits which fuel illcit drug trafficking networks, saying it was “worthy of serious consideration.”
Remarkable drug policy developments are taking place in Latin America. This is not only at the level of political debate, but is also reflected in actual legislative changes in a number of countries. All in all there is an undeniable regional trend of moving away from the ‘war on drugs’. This briefing explains the background to the opening of the drug policy debate in the region, summarises the most relevant aspects of the ongoing drug law reforms in some countries, and makes a series of recommendations that could help to move the debate forward in a productive manner.
The most important story of the Summit of the Americas was the Latin American demand to open the debate on an alternative to the ‘war on drugs’. The emergence of an increasingly independent and assertive Latin America insisting on a change of direction on drugs reflects an important shift in the terms of the relationship with the United States. Clamor for “democratization” of the debate and a search for new alternatives stems from the perception that Latin American societies pay a disproportionate price in lost lives, hijacked justice systems, abuses in overcrowded prisons, and displaced small farmers, because of the U.S.-led strategy that has prioritized stemming the supply of drugs over reducing its own demand.
The Organization of American States' (OAS) latest drug consumption report highlights shifting trends in drug use among youths in the Western Hemisphere. One noteworthy trend is changing cocaine consumption among high school students in South America, when compared to the United States -- the region's largest overall drug consumer. While cocaine use among US high school students has declined since peaking in 1998, consumption in South America has increased, most notably in Argentina and Uruguay, and less so in other nations like Chile and Brazil.
Argentina has given the first sign that Uruguay’s groundbreaking cannabis reform just may have started a domino effect across Latin America. Following the momentous vote by its smaller neighbor’s senate this month — making it the first nation in the world to completely legalize the cannabis — Argentina’s anti-drug czar Juan Carlos Molina has called for a public discussion in his country about emulating the measure. His comments are the clearest sign yet that Uruguay’s strategy has kicked off a trend in the region.
The Uruguay Senate approved a bill to legalize marijuana and put its trade into state hands, in what many experts said marks a new model for the war on drugs in its principal battleground of Latin America. President José Mujica plans to sign the bill, which passed the lower house of Congress in July, into law. A Uruguayan state agency will oversee the distribution and sale of marijuana. The goal is to cut out drug trafficking and reduce the violence associated with it.

The legalization of recreational marijuana in the U.S. states of Washington and Colorado will force Mexico to rethink its efforts to halt marijuana smuggling across the border, the main adviser to Mexico's president-elect said. Luis Videgaray, head of incoming President Enrique Pena Nieto's transition team, told Radio Formula that the Mexican administration taking power in three weeks remains opposed to drug legalization.
A group of Latin American leaders declared that votes by two U.S. states to legalize marijuana have important implications for efforts to quash drug smuggling, offering the first government reaction from a region increasingly frustrated with the U.S.-backed war on drugs. The declaration by the leaders of Mexico, Belize, Honduras and Costa Rica did not explicitly say they were considering weakening their governments' efforts against marijuana smuggling, but it strongly implied the votes last week in Colorado and Washington would make enforcement of marijuana bans more difficult.
Colombia, Guatemala, and Mexico – hardly liberal bastions – have taken the matter a step further. The Latin American countries, each threatened by drug violence, sent a clearly worded declaration to the United Nations, inviting member states to undertake a consultation process to come up with more effective drug policy strategies. They urged the UN to “exercise its leadership…. to conduct deep reflection to analyze all available options, including regulatory or market measures, in order to establish a new paradigm,” the declaration states, translated into English by the Guatemala Times.
Given the recent calls by several Latin American presidents for a debate on legalising drugs, would the United States show any flexibility in its stance on prohibition? “None,” was the answer of Joe Biden, America’s vice-president, who was in Mexico City on March 5th to meet the three main contenders in July’s presidential race. Mr Biden arrived under unprecedented pressure from regional presidents for the United States to give way on prohibition, which many in the region blame for generating appalling violence.
The presidents of Mexico, Colombia and Guatemala all called for a vigorous global debate of drug laws at the United Nations on Wednesday, raising new questions about the wisdom of the four-decade-old, U.S.-led "war on drugs." Although none of the leaders explicitly called for drugs to be legalized, they suggested at the U.N. General Assembly that they would welcome wholesale changes to policies that have shown scant evidence of limiting drug flows. Guatemalan president Perez Molina said his government "would like to establish an international group of countries that are well disposed to reforming global policies on drugs."
Ending the consumption and the trafficking of illegal drugs is “impossible”, according to Felipe Calderón, Mexico’s outgoing president. In an interview with The Economist Mr Calderón, whose battle with organised crime has come to define his six years in office, said that countries whose citizens consume drugs should find "market mechanisms" to prevent their money from getting into the hands of criminals in Latin America.
Across the Americas, an unprecedented debate on drug policy reform is underway. While a regional consensus on what form those reforms should take remains elusive, there are at least two issues where consensus is growing: the need to address drug use as a public health, rather than criminal, issue and the need to promote alternatives to incarceration for low-level, nonviolent drug offenders and ensure proportionality in sentencing for drug-related crimes. Draconian drug laws were often adopted in Latin American countries with the encouragement – if not outright diplomatic, political and economic pressure – from the U.S. government.
Jamaica's current volatile security environment and its economic malaise are reasons enough to seriously consider joining their Latin American counterparts to debate a raft of new policy options, not only in rhetoric, but also through public policy. Our prison conditions and local magistrate courts are bursting at their seams from inmate overcrowding and case overloads for marijuana possession that amount to miniscule consumption levels.
Political divides in the Central American region around drug control surfaced sharply at the recent regional summit on “New Routes against Drugs Trafficking”, that took place on Saturday 24 March in Guatemala. Guatemalan President Otto Pérez Molina called for an open debate on the security crisis and on policies to reduce the rampant drug-related violence, stating that current policies have been so ineffective that all options including the ‘depenalisation’ of drugs should be on the table.
