The growing societal acceptance of cannabis in the U.S. has sparked what some call a "green rush" of people trying to cash in on what is already a multi-billion-dollar business. And as the marijuana industry comes out of the shadows, its producers, consumers and advocates are pushing for more transparency – both about cannabis' alleged medical benefits and its environmental impacts.
Denver prosecutors will no longer charge those 21 and older for carrying less than an ounce of marijuana, and will review current cases that fit under the language of a recently voter-approved state constitutional amendment. District Attorney Mitch Morrissey and City Attorney Doug Friednash made their decision a day after Boulder County District Attorney Stan Garnett made headlines when he announced his office will dismiss any pending cases that deal with less than an ounce of marijuana.
Three marijuana legalization initiatives were on the ballot this week, and all three won. That’s a better outcome than I was expecting. I was surprised when voters in Colorado and Washington approved legalization two years ago, and I was surprised again when voters in Alaska, Oregon, and Washington, D.C., followed suit. Partly that’s because, after 25 years of advocating drug legalization (along with various other unpopular positions), I am accustomed to losing. But it’s also because I had looked at the polling data.
In a decision that could have immediate fallout for medical marijuana dispensaries, a state appeals court has ruled that California law allows cities and counties to ban the stores. The contentious issue has bounced through the state courts for years, but the opinion issued Wednesday is the first published one that directly tackles it and does so in unambiguous language. The decision could embolden more cities and counties to enact their own. It also could spur those that have bans to be more aggressive about seeking court orders to close defiant dispensaries.
In 2012, voters in the US states of Washington, Colorado and Oregon were given the opportunity to vote in ballot initiatives for the creation of legally regulated cannabis markets. Washington’s Initiative 502 and Colorado’s Amendment 64 both passed with 55.7% and 55.3% of the vote respectively. Oregon’s Measure 80 failed with 53.4% of those voting rejecting the measure. As calls for and legal processes towards the initiation of cannabis policy reform become more common within US states, it is a timely and useful exercise to reflect upon the campaigns for reform in Washington (WA), Colorado (CO) and Oregon (OR) and examine why the public supported cannabis policy reform in some instances and not others.
Several members of California's congressional delegation are taking their concerns about a federal crackdown on the state's medical marijuana dispensaries directly to President Barack Obama. In a bipartisan letter signed by nine members of the U.S. House of Representatives, the lawmakers criticized what they called an "unconscionable" multi-state effort targeting medical marijuana dispensaries. They also called for the reclassification of marijuana as a controlled substance subject to fewer federal restrictions.
America’s four-decade war on drugs is responsible for many casualties, but the criminalization of marijuana has been perhaps the most destructive part of that war. The toll can be measured in dollars — billions of which are thrown away each year in the aggressive enforcement of pointless laws. It can be measured in years — whether wasted behind bars or stolen from a child who grows up fatherless. The American Civil Liberties Union (ACLU) plans to stay on the sidelines of future pot legalization campaigns – already supported by groups plotting ballot campaigns in 2016 – and pour resources into fights for criminal justice reform. One model to replicate is California's Proposition 47, approved by 58 percent to lower penalties for drug possession and other nonviolent crimes. "We would love to be able to have ballot initiatives in a number of states that may look very similar to Proposition 47," says ACLU's Alison Holcomb . Oregon voters will decide whether to legalize marijuana for recreational use after state elections officials said the measure qualified for the November 2014 ballot. The measure would allow adults 21 and older to buy and possess marijuana and would give the Oregon Liquor Control Commission the job of regulating and taxing the drug. Voters rejected a legalization measure two years ago, but little money was spent promoting it. By contrast, New Approach Oregon, the group behind the initiative, has received contributions from some of the same donors who backed successful marijuana initiatives in Washington and Colorado.
Illicit drugs made from plants (e.g., cocaine, heroin) are being replaced in some national drug markets by those that are synthesized (e.g., methamphetamine, fentanyl). The U.S. has had a parallel experience in the past decade with the rise of illicit consumption of synthetic opioids and cannabinoids. If illicit drug markets continue to separate from an agricultural base, it would upend traditional understandings of drug markets and drug policy.
At the root of the drug policy debate in Latin America is growing recognition that present policies have failed to achieve the desired objectives, the extremely high costs of implementing those policies paid by Latin American countries, and the need to place higher priority on reducing unacceptably high levels of violence. Of particular concern is the spread of organized crime and the resulting violence, corruption and erosion of democratic institutions.
Smoking, growing, buying, selling or merely possessing cannabis is a criminal offence, according to America's federal government. Ask the states, however, and you will get almost 50 different answers. In 13 of them possession of the drug has been decriminalised, meaning that tokers face only minor penalties if caught. In 23 it has been legalised for medical use. And in four—including, following ballot initiatives earlier this month, Alaska and Oregon—cannabis has been legalised outright. In all only 22 states, fewer than half the total, continue to treat the drug as criminal contraband under all circumstances.
No sooner had the Times published its opening editorials advocating legalization of marijuana than the White House fired back with an unconvincing response on its website. It argued that marijuana should remain illegal because of public health problems “associated” (always a slippery word) with increased marijuana use. Careful readers will immediately see the White House statement for what it is: A pro forma response to a perceived public relations crisis, not a full-fledged review of all the scientific evidence.
Oregon and Alaska have become the latest US states to legalise recreational marijuana in ballots hailed by supporters as evidence that a national change of policy is underway. Voters in both states approved laws which will permit residents over 21 to grow their own marijuana and establish a legal retail trade. The results, which followed the legalisation of recreational marijuana in Washington state and Colorado two years ago, were cheered by national campaigns as evidence of a gathering movement to challenge federal laws banning the drug. Retail marijuana sales for adults are now legal (at least at the state level) in Colorado and Washington. Next month, voters in Alaska and Oregon may decide to follow suit. It is nearly certain that marijuana legalization will make it onto the California ballot in 2016, during a presidential election season that will generate enormous interest among young voters. The decision by California voters in 1996 to legalize medical marijuana produced a wave of similar initiatives around the country. Less than two decades later, over half the states allow at least limited medical use. Now it looks as though recreational use of the drug may follow the same path. In 2012, Washington State and Colorado legalized recreational marijuana. This November, voters in Alaska, Oregon and the District of Columbia will decide whether to do the same — effectively disregarding the misguided federal ban on a drug that is far less dangerous than alcohol.
