    In 2019, a wave of mass protest movements has spread across North Africa and West Asia, including Sudan, Algeria, Iraq, Lebanon and Iran. The mass protests have much in common, from opposing authoritarian regimes and worsening economic situations to demanding radical changes in social relations. Despite their similarities, each protest movement operates under different conditions that cannot be ignored. The specific historic, political and economic contexts of each country have determined who the key actors of the uprisings are and their location across old and new divides. This book elaborates on these similarities and differences to paint a clearer picture of these movements and draw out important lessons to inform future struggles.

    En los años 90, los gobiernos peruanos firmaron numerosos tratados bilaterales de inversión que le daban el derecho exclusivo a empresas extranjeras de demandar al país andino ante tribunales de arbitraje internacional. Fue en la segunda década del siglo XXI cuando los inversores tomaron nota y empezaron a demandar a Perú masivamente. Tal es la magnitud de demandas que hoy en día Perú es el cuarto país más demandado de América Latina y el Caribe. Y entre el 2019 y el 2020, fue por lejos el país más demandado a nivel mundial. No obstante, los gobiernos peruanos no revisaron su política de firmar acuerdos con cláusula de protección de inversiones, más bien la ratificaron año tras año.

    Peru, Mexico, Argentina, Bolivia and Guatemala are just some of the Latin American countries being hit by the investment protection regime in the midst of the COVID-19 pandemic. Foreign investors are threatening to bring claims before international arbitration tribunals due to the measures states are taking to mitigate the effects of the pandemic. Arbitrators are refusing to accept states’ requests to postpone ongoing arbitration cases and are obliging governments to disburse millions to investors at a time when public funds are required for more urgent priorities. Once again, the current crisis reveals the perverse consequences of the investor-state dispute settlement system and the urgent need to break free from it.
