En su Informe correspondiente a 2022, la Junta Internacional de Fiscalización de Estupefacientes (JIFE), el “órgano independiente y cuasi judicial constituido por expertos”1 que supervisa la aplicación de los tratados de fiscalización de drogas de la ONU, se centra en la legalización del cannabis. Cada año, en el primer capítulo de su informe anual, la Junta aborda una cuestión específica que considera importante para los debates sobre políticas de drogas y el funcionamiento del sistema internacional de fiscalización de estupefacientes. Este año se centra en la legalización del cannabis, porque, como muchos han observado, una década después de que el primer Estado regulara legalmente el cannabis recreativo para adultos, “un número creciente de Estados ha adoptado políticas que permiten el consumo de cannabis con fines no médicos ni científicos”.

A response to the annual report of the International Narcotics Control Board In its report for 2022, the International Narcotics Control Board (INCB), the “independent, quasi-judicial expert body”1 that monitors the implementation of the UN drug control conventions, focuses on the legalisation of cannabis. Each year, in the first chapter of its annual report, the Board addresses a specific issue it deems important for drug policy discussions and the functioning of the international drug control system. This year, cannabis legalisation is the focus, because as many have noticed, a decade after the first state legally regulated adult recreational cannabis “a growing number of States have adopted policies that permit the use of cannabis for non-medical and non-scientific purposes”.

Cannabis policy developments have arrived at an important moment where the treaty issue needs to be confronted in an honest manner, and not by hypocritical denials or fantasy interpretations that undermine basic principles of international law and cannot stand the scrutiny of ‘good faith’ treaty interpretation.
